Kendall Len Burgess, Sexual Abuse of Child, Oklahoma 2021

MUSKOGEE, OKLAHOMA

A federal jury in Muskogee, Oklahoma has delivered a guilty verdict against Kendall Len Burgess, a 22-year-old resident of Henryetta, Oklahoma. Burgess was charged with Aggravated Sexual Abuse in Indian Country and Abusive Sexual Contact in Indian Country.

The jury trial, which began on Monday, July 19, 2021, concluded on Wednesday, July 21, 2021, with the guilty verdicts. During the trial, the United States presented evidence that Burgess perpetrated various sexual acts on a seven-year-old victim.

The United States Attorney’s Office for the Eastern District of Oklahoma prosecuted the case because Burgess is a member of a federally-recognized Indian tribe and the crime occurred in Okmulgee County, within the boundaries of the Muscogee (Creek) Nation, and within the Eastern District of Oklahoma.

The guilty verdicts were the result of an investigation by the Henryetta Police Department, Okmulgee County Sheriff’s Office, and the Federal Bureau of Investigation. Burgess was remanded to the custody of the United States Marshal pending the imposition of sentencing.

The Honorable Ronald A. White, U.S. District Judge in the United States District Court for the Eastern District of Oklahoma in Muskogee, presided over the trial and ordered the completion of a presentence report. Sentencing will be scheduled following completion of the report.

Burgess is facing imprisonment for not less than 30 years to life for the crimes the jury found he committed. The defendant was acquitted on one count of Assault by Striking, Beating, or Wounding in Indian Country.
