URBANA, Ill. – Kevin Marshall, 32, of Danville, Illinois, is facing the ultimate penalty after a grand jury handed down a superseding indictment charging him with the brutal carjacking and murder of 28-year-old Daniel Walter of Williamsport, Indiana. The crime allegedly occurred on or about April 25, 2020, and marks a chilling escalation in the ongoing struggle against violent crime in central Illinois.
Prosecutors allege Marshall didn’t just steal Walter’s 2005 Ford F-150 – he murdered him in the process, using a Taurus 9mm handgun. The indictment details a pattern of criminal behavior, claiming Marshall illegally possessed not only the 9mm but also a Colt .45 caliber handgun and a Phoenix Arms .22LR caliber handgun between April 14, 2020, and August 18, 2020. A prior state conviction for second-degree murder, involving the use of a firearm, further darkens Marshall’s record.
The feds aren’t stopping at the carjacking and murder. Marshall is also accused of running a methamphetamine operation, allegedly possessing over 50 grams of the drug with the intent to distribute between July 24, 2020, and August 18, 2020. The indictment claims he carried the Taurus 9mm and Colt .45 during these drug transactions, linking the firearms directly to his alleged trafficking activities. The grand jury found evidence suggesting the carjacking and murder were not impulsive acts, but rather committed with substantial planning, premeditation, and the clear expectation of financial gain.
Marshall was initially arrested in Danville on August 18, 2020, and previously charged with being a felon in possession of firearms on August 3, 2021. He’s been cooling his heels in pretrial detention ever since. This superseding indictment, however, dramatically raises the stakes. Assistant U.S. Attorneys Bryan D. Freres and Eugene L. Miller are leading the prosecution, working alongside Vermilion County State’s Attorney Jacqueline Lacy.
If convicted on the charges of carjacking resulting in death and murder with a firearm, Marshall faces a grim future: up to life imprisonment, or potentially the death penalty. This case highlights the ATF’s commitment to investigating violent crimes involving firearms and bringing perpetrators to justice. The investigation involved a multi-agency effort, including the Danville Police Department, the FBI’s Springfield Field Office, the Illinois State Police, the U.S. Marshals Service, the Vermilion County Sheriff’s Office, and of course, the Bureau of Alcohol, Tobacco, Firearms and Explosives.
It’s crucial to remember that this indictment is just an accusation. Kevin Marshall is presumed innocent until proven guilty in a court of law. However, the evidence presented to the grand jury paints a disturbing picture of a dangerous individual allegedly involved in a deadly combination of violent crime and drug trafficking. The trial promises to be a brutal reckoning for all involved, and Grimy Times will be there to report every twist and turn.
