Kyle Mackay, Possession of a Firearm by a Prohibited Person, South Dakota 2021

RAPID CITY – Kyle Mackay, 33, has been sentenced to four years in federal prison for possessing a firearm by a prohibited person, U.S. Attorney Alison J. Ramsdell announced Monday.

According to officials, Mackay was identified as an unwanted subject at a gas station in Rapid City in January 2021. Law enforcement discovered a firearm and approximately a half ounce of methamphetamine on his person. The firearm was later found to be stolen.

Mackay had a previous felony conviction, making him prohibited from possessing firearms.

The case is part of Project Safe Neighborhoods, a program aimed at reducing violent crime and gun violence. The program brings together law enforcement and community organizations to make neighborhoods safer.

The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives, Rapid City Police Department, Dakota Territory Fugitive Task Force, and the Pennington County Sheriff’s Office. Assistant U.S. Attorney Kathryn N. Rich prosecuted the case.

Mackay was remanded to the custody of the U.S. Marshals Service immediately after the sentencing. U.S. District Judge Jeffrey L. Viken handed down the sentence on April 24, 2023, also ordering Mackay to pay a $100 special assessment to the Federal Crime Victims Fund.

The case highlights the ongoing efforts to combat gun violence and reduce crime in South Dakota. As part of the Project Safe Neighborhoods program, law enforcement and community organizations are working together to make neighborhoods safer for everyone.
