Emmanuel Lopez, Heroin and Fentanyl Distribution, New York 2017

A Buffalo man is facing serious time behind bars after a federal grand jury indicted him on heroin and fentanyl distribution charges. Emmanuel Lopez, 27, of Buffalo, NY, was charged with possession with intent to distribute, and distribution of, 100 grams or more of heroin and 40 grams or more of fentanyl.

The charge carries a minimum penalty of five years in prison, a maximum of 40 years, and a $5,000,000 fine. According to the U.S. Attorney’s Office, the indictment is the result of an investigation by Immigration and Customs Enforcement, Homeland Security Investigations, Border Enforcement Security Team.

Assistant U.S. Attorney Timothy C. Lynch, who is handling the case, stated that according to the indictment and a previously filed complaint, between 2016 and December 5, 2017, Lopez sold heroin and fentanyl in the Buffalo area. In October, 2017, the ICE-HSI Border Enforcement Security Team (BEST) conducted a controlled purchase from Lopez.

During the buy, Lopez turned over 24 small yellow bags which later tested positive for heroin, fentanyl, and tramadol. The investigation was led by Special Agent-in-Charge Kevin Kelly, and the case is being prosecuted by Assistant U.S. Attorney Timothy C. Lynch.

The fact that a defendant has been charged with a crime is merely an accusation and the defendant is presumed innocent until and unless proven guilty. U.S. Attorney James P. Kennedy, Jr. announced the indictment, which is a significant development in the ongoing efforts to combat heroin and fentanyl trafficking in the Buffalo area.
