Charles Edward Bayer, Jr., 31, of Lafayette, Louisiana, stood before a federal judge in Syracuse today and admitted his role in a nationwide scheme to cheat vehicle emissions inspections. Bayer pled guilty to one felony count of conspiracy to commit mail fraud and violate the Clean Air Act, marking a key victory for federal environmental prosecutors.
Bayer admitted that from 2011 to 2013, he helped design, manufacture, and sell motor vehicle simulator devices engineered to bypass mandatory emissions tests. These devices, once installed, allowed vehicles to pass inspections while spewing illegal levels of pollution. The scam stretched across state lines, with Bayer and his co-conspirators selling at least 170 of the fraudulent units throughout the U.S.
When one co-conspirator got spooked—fearing the Environmental Protection Agency was closing in—Bayer didn’t back down. Instead, he bought the remaining inventory, source codes, and customer list, then kept the operation running. He wasn’t just a participant; he admitted in court to being a leader in the conspiracy, which involved at least five individuals operating in the shadows of the auto repair underground.
To mask the illegal purpose of the devices, Bayer added a flimsy disclaimer to the instructions: ‘for development/off road use only.’ It was a paper-thin cover for a deliberate, profit-driven fraud. He knew buyers were using the gadgets to deceive inspectors and skirt environmental laws—yet he pushed them harder, profiting from the pollution.
The charge carries a maximum sentence of 5 years in prison and a fine of up to $250,000. No deal was made for leniency. Senior District Judge Norman A. Mordue will impose sentence on May 11, 2017, weighing the damage done to public health and regulatory integrity.
The investigation was led by EPA-CID and the New York State Department of Environmental Conservation. The case was prosecuted by Assistant U.S. Attorney Michael F. Perry and Senior Trial Attorney Todd Gleason—both determined to send a message: cheat the environment, and the feds will come knocking.
