Lower Brule Man Sentenced for Sex Abuse of Minor

A 25-year-old man from Lower Brule, South Dakota, has been sentenced to 22 months in custody for sexually abusing a minor. Daniel Berry, 25, was convicted of the crime and sentenced by U.S. District Judge Roberto A. Lange on November 17, 2014.

The crime occurred between January 1, 2012, and January 31, 2012, when Berry had sexual intercourse with an underage female victim at a party at his house. Berry was having a party at his home and took advantage of the victim during that time.

Berry was indicted by a federal grand jury on April 15, 2014. He pled guilty on September 11, 2014. The conviction stems from this incident.

Assistant U.S. Attorney Meghan N. Dilges prosecuted the case. The Bureau of Indian Affair, Lower Brule Agency, investigated the case. Berry was immediately turned over to the custody of the U.S. Marshals Service.

In addition to the 22 months in custody, Berry was also sentenced to 5 years of supervised release and a $100 special assessment to the Federal Crime Victims Fund. Berry must also register as a sex offender.
