NEW ORLEANS – Luis Lemus-Martinez, a 34-year-old Honduran national, has been indicted for illegal re-entry of a removed alien, in violation of Title 8, United States Code, Section 1326(a), announced U.S. Attorney Duane A. Evans.
According to the indictment, Lemus-Martinez reentered the United States after being previously deported on October 14, 2009.
U.S. Attorney Evans reiterated that an indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.
U.S. Attorney Evans praised the work of Homeland Security Investigations in investigating this matter. Assistant U.S. Attorney Carter K.D. Guice, Jr., of the General Crimes Unit, is in charge of the prosecution.
If convicted, Lemus-Martinez faces up to two years imprisonment, up to a $250,000 fine, up to one year of supervised release, and a mandatory $100 special assessment fee.
Lemus-Martinez’s indictment is a reminder of the consequences of re-entering the United States after being deported. This crime is a serious offense that can result in significant prison time and fines.
The U.S. Attorney’s Office will continue to work with federal and local law enforcement agencies to investigate and prosecute those who violate our nation’s immigration laws.
