CONCORD – A Maine man has admitted to spiking ice cream with THC, leading to a health scare in Newmarket. Marc Flore, 45, from Portland, pleaded guilty in federal court for tampering with consumer products.
Flore faces up to 10 years in prison and a $250,000 fine after authorities linked him to the batch of coffee Oreo ice cream that sickened four people in March 2023. The victims experienced dizziness, vomiting, and three were hospitalized briefly.
According to court documents, Flore added THC to the ice cream he intended for personal use in September 2022. He then stored it in Angelo’s Amore ice cream café’s freezer without proper labeling. Staff unknowingly served the THC-laced product, leading to the health crisis.
Judge Landya McCafferty scheduled Flore’s sentencing for November 4, 2025. Assistant U.S. Attorney Charles L. Rombeau is handling the prosecution.
The investigation was led by the FDA Office of Criminal Investigations and the Newmarket Police Department. Sentences are imposed by federal district court judges based on U.S. Sentencing Guidelines and statutes.
Flore could be sentenced to up to 10 years in prison and a maximum fine of $250,000 for his actions.
