CONCORD – Marc Flore, a 45-year-old man from Portland, Maine, has pleaded guilty in federal court in Concord for his role in the production of THC-laced ice cream that sickened four people in Newmarket. The incident occurred on March 2023, according to Acting U.S. Attorney Jay McCormack.
Flore admitted to adding THC to a batch of coffee Oreo ice cream intended for personal use, which he then stored at Angelo’s Amore ice cream café. Unbeknownst to the staff, this contaminated ice cream was mixed with commercial batches and served to unsuspecting customers. The affected individuals experienced dizziness, elevated heart rates, vomiting, and one required hospitalization.
The investigation led by the Food and Drug Administration (FDA) Office of Criminal Investigations and the Newmarket Police Department uncovered that Flore had added the THC in September 2022 but failed to label the batch as containing the illegal substance. Flore faces up to 10 years imprisonment and a $250,000 fine for the charge of tampering with consumer products.
Sentencing has been scheduled for November 4, 2025, before Chief U.S. District Court Judge Landya McCafferty. Assistant U.S Attorney Charles L. Rombeau is handling the prosecution of this case.
According to the charging documents and statements in court, the affected customers experienced dizziness, elevated heart rates, vomiting, and one required hospitalization. The incident has sparked concerns over food safety and the potential dangers of clandestine drug manufacturing practices in food products.
Flore’s actions have not only endangered public health but also compromised the integrity of the food service industry. His plea and pending sentencing serve as a stark reminder of the consequences faced by those who tamper with consumer goods, putting lives at risk.
