A disturbing crime has shaken the quiet town of Eagle Butte, South Dakota. Brad Lee Red Bear, a 23-year-old man from the area, has been indicted by a federal grand jury for Aggravated Sexual Abuse by Force.
According to the indictment, Red Bear allegedly forcibly sexually assaulted a woman in December 2013. The charge is merely an accusation, and Red Bear is presumed innocent until proven guilty.
Red Bear appeared before U.S. Magistrate Judge Veronica L. Duffy on February 18, 2014, and pled not guilty to the Indictment. He was released on bond, but a trial date has not been set.
The maximum penalty upon conviction is up to life in custody and/or a $250,000 fine, 5 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation is being conducted by the Federal Bureau of Investigation and the Cheyenne River Sioux Tribe Law Enforcement Services. Assistant U.S. Attorney Mikal Hanson is prosecuting the case.
