Man Stomps Victim to Death on Concrete Floor
McLaughlin, SD – Ross Dean Farrell, 21, has pleaded guilty to Assault with Intent to Commit Murder, a felony charge that could land him in prison for up to 20 years and cost him $250,000 in fines.
U.S. Attorney Brendan V. Johnson announced the guilty plea, which was entered on May 28, 2013, before U.S. District Judge Charles B. Kornmann.
According to the indictment, Farrell’s attack on the victim, whose name has not been released, was sparked by a perceived slight he received from either the victim or another person. The incident occurred in the basement of Farrell’s home, where he and the victim were socializing with others.
Farrell, outraged by the perceived insult, pulled the victim off a mattress and onto the cement floor, where he repeatedly stomped on his head and face with his shod feet. The attack was so severe that the victim required hospitalization, emergency surgeries, and was placed in a medically induced coma.
The victim suffered severe head trauma as a result of the attack, and the motive behind the assault was clearly to kill, according to authorities. The investigation was conducted by the Bureau of Indian Affairs, Standing Rock Agency, and Assistant U.S. Attorney Troy R. Morley is prosecuting the case.
Farrell was remanded to the custody of the U.S. Marshals Service pending sentencing, which has been set for September 9, 2013. Restitution and a $100 special assessment to the Federal Crime Victims Fund may also be ordered as part of his sentence.
A 20-year prison sentence is the maximum penalty upon conviction, and a fine of $250,000, or both, is also possible. In addition, Farrell faces 3 years of supervised release and an additional 2 years of supervised release upon revocation.
