Marc Henry Johnson, Cocaine Cover-Up, Manhattan NY, 2017

Manhattan, NY – Marc Henry Johnson, 53, will spend over a year in federal prison for a callous act of self-preservation that followed the fatal cocaine overdose of a 38-year-old woman. Johnson was sentenced today to one year and one day for acting as an accessory after the fact, assisting drug dealer James Holder in concealing his role in the woman’s death.

According to court documents, Johnson regularly purchased cocaine from Holder, who operated a drug-dealing operation out of his Chelsea apartment. On the night of October 3, 2015, Johnson and the victim – identified as “Individual-1” – spent time at a Manhattan bar where the woman was already using cocaine. The pair then traveled to Holder’s apartment building around 4:25 a.m.

Hours later, Johnson and Holder were caught on camera dragging the woman’s unconscious body into the building’s vestibule. Holder fled the scene, leaving Johnson to make a 911 call. Crucially, Johnson deliberately withheld vital information from the emergency operator, failing to identify himself, the victim, or explain the circumstances of the overdose. He left before paramedics arrived. The victim was rushed to a hospital, but was pronounced dead later that day, the cause of death listed as cocaine intoxication.

Acting U.S. Attorney Joon H. Kim minced no words, stating, “Faced with a choice between helping his long-time drug dealer avoid arrest or helping a woman survive a cocaine overdose, Marc Henry Johnson chose to help the drug dealer. For his callous and illegal choice, Johnson will now join that drug dealer in federal prison.” Johnson’s sentence also includes two years of supervised release and a $20,000 fine.

This sentencing follows the earlier conviction of James Holder, who pled guilty to maintaining a drug-involved premises on December 12, 2016, and received a five-year prison sentence on May 11, 2017. The investigation was a collaborative effort led by the U.S. Drug Enforcement Administration’s (DEA) New York Organized Crime Drug Enforcement Strike Force, involving a dozen federal, state, and local agencies including the U.S. Secret Service.

The prosecution, handled by Assistant U.S. Attorneys Margaret Garnett and David Abramowicz, highlights the lengths to which individuals will go to protect their criminal associates, even at the cost of another’s life. This case serves as a grim reminder of the deadly consequences of the drug trade and the importance of accountability for those who enable it.
