Marijuana Ring Member Pleads Guilty
Lena Flying By, a 46-year-old resident of Eagle Butte, South Dakota, pleaded guilty on May 7, 2013, to Possession with Intent to Distribute a Controlled Substance, a charge stemming from a marijuana trafficking operation in her home.
According to the indictment, Flying By admitted to aiding and abetting the selling of marijuana in her residence. The investigation, conducted by the Northern Plains Safe Trails Drug Enforcement Task Force and the Cheyenne River Sioux Tribe Law Enforcement, revealed that Flying By was involved in the distribution of marijuana.
The case began with a vehicle stop by Cheyenne River law enforcement, during which the driver claimed to have purchased marijuana from a residence in Eagle Butte. A search warrant was obtained, and law enforcement discovered marijuana and other drug paraphernalia at the residence.
The maximum penalty for Flying By’s conviction could be up to 5 years of imprisonment, a $250,000 fine, or both. She may also face a mandatory period of 2 years of supervised release and an additional year of supervised release upon revocation. Additionally, restitution and a $100 special assessment to the Federal Crime Victims Fund may be ordered.
Flying By was released on bond pending sentencing, which has been set for July 22, 2013. Assistant U.S. Attorney Kathryn N. Rich is prosecuting the case.
The guilty plea marks a significant blow to a marijuana trafficking operation in Eagle Butte, and authorities are urging continued vigilance in the fight against drug trafficking in the region.
