Marvin Tobar, Gun Possession, Indiana 2024

On the afternoon of April 22, 2018, South Bend resident Marvin Tobar, 29, unleashed a hail of gunfire in a local neighborhood, discharging twenty rounds from a .223 caliber rifle and leaving a trail of chaos in his wake.

According to eyewitnesses, Tobar fired his rifle from the road in a residential area, striking at least one vehicle parked down the street. The incident drew a crowd, with numerous people present at the time of the shooting.

After firing his rifle, Tobar fled to a nearby house, where he hid the gun in a crawlspace and the magazine in a closet. When police arrived on the scene, they discovered the rifle, which still had one live round in the chamber, but an empty magazine.

Tobar’s reckless behavior has a history of violence. He has three prior convictions for misdemeanors and two prior felonies, including a 2011 conviction for reckless homicide. In that incident, Tobar pulled a handgun during a confrontation, sparking a shootout that resulted in the death of another man.

Tobar’s recent conviction for possession of a firearm after being convicted of a felony offense has earned him a 64-month prison sentence, to be followed by one year of supervised release.

The case was investigated by the ATF, with assistance from the South Bend Police Department. Assistant U.S. Attorney Joel Gabrielse handled the case.

Marvin Tobar, age 29, of South Bend, Indiana, was sentenced before South Bend District Court Judge Jon E. DeGuilio for possession of a firearm after having been convicted of a felony offense, announced U.S. Attorney Kirsch.
