Former Kay County Corrections Officer Indicted for Civil Rights Violations
A former supervisory corrections officer at the Kay County Detention Center in Newkirk, Oklahoma has been charged with civil rights violations. Matthew Ware, a former Kay County Oklahoma Supervisory Corrections Officer, was indicted on three counts of federal civil rights violations.
The indictment alleges that on May 18, 2017, Matthew Ware was deliberately indifferent to a substantial risk of serious harm to two pretrial detainees, identified as D.W. and M.M. Ware ordered corrections officers to move D.W. and M.M. to a cell row housing inmates who posed a danger to them. The inmates were then ordered to be unlocked at the same time, resulting in physical attacks on D.W. and M.M.
According to the indictment, D.W. and M.M. sustained bodily injury as a result of the attack. The indictment further alleges that on January 31, 2018, Ware violated the constitutional rights of a pretrial detainee, identified as C.D., by ordering corrections officers to apply restraints in an unreasonable manner. C.D. also sustained bodily injury as a result.
Matthew Ware faces a maximum sentence of 10 years in prison, three years of supervised release, and a fine of up to $250,000 on each count. The case was investigated by the Oklahoma City FBI Field Office and is being prosecuted by Assistant U.S. Attorney Julia Barry of the Western District of Oklahoma and Trial Attorney Laura Gilson of the Civil Rights Division.
An indictment is a formal accusation of criminal conduct, not evidence of guilt. Matthew Ware is presumed innocent unless proven guilty.
The U.S. Attorney’s Office for the Western District of Oklahoma and the Civil Rights Division are committed to holding accountable those who violate the civil rights of others.
The case, US v. Matthew Ware, was brought pursuant to the Civil Rights of Institutionalized Persons Act (CRIPA) and the Violent Crime Control and Law Enforcement Act of 1994.
