Two New York ophthalmology practices, Mark D. Fromer, P.C. and Floral Park Ophthalmology P.C., have been caught in a Medicare scam, agreeing to pay $2.3 million to settle allegations of fraudulent claims for unnecessary trans-cranial doppler ultrasounds in Florida. The practices allegedly submitted false claims to Medicare and Medicaid through a kickback arrangement with a third-party testing company. The scheme compromised the integrity of the healthcare system, prioritizing profits over patient care.

The settlement resolves allegations that the practices knowingly submitted false claims for medically unnecessary ultrasounds, driving up healthcare costs for everyone. The Department of Justice and the Department of Health and Human Services Office of Inspector General (HHS-OIG) worked together to investigate and hold the practices accountable.

The practices have agreed to cooperate with ongoing investigations into other participants in the alleged scheme. U.S. Attorney Gregory W. Kehoe for the Middle District of Florida stated that medical service providers who prioritize profits over patients compromise the healthcare system. Assistant Attorney General Brett A. Shumate and Special Agent in Charge Isaac M. Bledsoe also emphasized the importance of sound medical advice free from illegal kickbacks and improper arrangements.
