Fernando Hernandez-Garfias, Illegal Reentry, Pennsylvania 2025

A 42-year-old Mexican national has been slapped with an indictment for Illegal Reentry, a charge that carries a maximum penalty of 2 years in the slammer.

Fernando Hernandez-Garfias, a 42-year-old citizen of Mexico, was hit with the indictment on June 18, 2025, by a federal grand jury in the Middle District of Pennsylvania. The indictment alleges that Hernandez-Garfias was found in York County, Pennsylvania, on May 7, 2025, after previously being removed from the United States.

According to Acting United States Attorney John C. Gurganus, Hernandez-Garfias had been removed from the United States on November 23, 2016, through Brownsville, Texas, and reentered without permission. The indictment claims that Hernandez-Garfias knowingly reentered the country without first obtaining legal permission to do so.

The case was investigated by U.S. Immigration and Customs Enforcement and Removal Operations and the Pennsylvania State Police. Assistant U.S. Attorney Scott R. Ford is prosecuting the case.

The indictment is part of a nationwide initiative called Operation Take Back America, a program aimed at combating illegal immigration, cartels, and transnational criminal organizations. The operation streamlines efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN).

Indictments are mere allegations, and Hernandez-Garfias is presumed innocent until proven guilty in court. The maximum penalty under federal law for this offense is 2 years of imprisonment, a term of supervised release following imprisonment, and a fine.
