TYLER, Texas – In a stunning revelation from the Eastern District of Texas, a Mexican national, Luis Donaldo Villanueva-Tapia, 30, has been slapped with federal charges for illegal gun possession. The grim details were announced by Acting U.S. Attorney Jay R. Combs, who revealed that Villanueva-Tapia is an illegal alien living in Tyler.
The defendant was indicted by a federal grand jury this week, charging him with being an illegal alien in possession of a firearm. According to the charges, on July 8, 2025, Villanueva-Tapia was discovered in the United States against his legal status and in possession of a firearm. This case is a pivotal part of Operation Take Back America, the Department of Justice’s relentless initiative to combat illegal immigration, dismantle cartels and transnational criminal organizations (TCOs), and safeguard communities from violent crime.
Operation Take Back America consolidates efforts and resources from the Department’s Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN). If convicted, Villanueva-Tapia could face up to 15 years in federal prison and be deported. This case has been a joint effort by the Bureau of Alcohol, Tobacco, Firearms, and Explosives; the U.S. Drug Enforcement Administration; Homeland Security Investigations; and the Tyler Police Department.
Assistant U.S. Attorney Dustin Farahnak is leading the prosecution against Villanueva-Tapia. It should be noted that a federal indictment is not evidence of guilt, and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
