NEW ORLEANS, LOUISIANA – A Mexican man is behind bars, charged with re-entering the United States after being deported.
Baltazar Garcia-Mendoza, 33, was slapped with a bill of information on May 24, 2024, charging him with re-entry of a previously removed alien. The crime, punishable under Title 8, United States Code, Section 1326(a), carries a maximum term of imprisonment of two years.
According to the bill of information, Garcia-Mendoza reentered the United States after being previously deported on February 3, 2014. This reckless act has put him in the crosshairs of the US Customs and Border Protection, who investigated the matter.
The Department of Justice’s USAO, led by U.S. Attorney Duane A. Evans, took a hard stance on the situation. ‘A bill of information is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt,’ Evans emphasized.
Garcia-Mendoza faces a long road ahead. The charges against him carry a potential fine of up to $250,000 and a mandatory special assessment fee of $100. He could also face up to one year of supervised release.
Assistant United States Attorney Jon M. Maestri of the General Crimes Unit is leading the prosecution. The federal government is taking a zero-tolerance approach to immigration crimes, and Garcia-Mendoza’s actions will be vigorously prosecuted.
