Mexican National Charged With Sex Offender Crime
A 40-year-old Mexican national is facing federal charges after violating U.S. immigration laws and neglecting to register as a sex offender.
Cosme Marin-Ponce, a Mexican national, was recently indicted by a federal grand jury for illegal reentry into the United States and for failing to register as a sex offender. The case against Marin-Ponce was unsealed after his arrest.
According to U.S. Attorney Gerard M. Karam, Marin-Ponce was previously removed from the United States on September 23, 2019, after pleading guilty to indecent assault of a person less than 13 years old. It is alleged that he re-entered the country without first obtaining legal permission to do so.
Martin-Ponce also failed to register as a sex offender, as required by law following his previous conviction. This matter was investigated by U.S. Immigration and Customs Enforcement and Removal Operations (ERO) and the United States Marshals Service.
Assistant U.S. Attorney Michael Scalera is prosecuting the case, and Marin-Ponce faces a maximum penalty of 10 years of imprisonment, a term of supervised release following imprisonment, and a fine. A sentence following a finding of guilt will be imposed by the judge after consideration of the applicable federal sentencing statutes and the Federal Sentencing Guidelines.
Indictments are only allegations, and Marin-Ponce is presumed to be innocent unless and until found guilty in court.
