Dan Rotta, Swiss Bank Scheme, Florida 2023

MIAMI – In a stunning reversal of fortune, Miami’s Dan Rotta has been sentenced to 60 months in the slammer for his decades-long scheme to dupe the IRS. The conman was caught hiding over $20 million in assets across secret Swiss bank accounts, using his Brazilian citizenship as a shield.

From 1985 to 2020, Rotta, a dual citizen of Brazil and the U.S., swindled millions by falsely claiming that his hidden wealth belonged to others, according to court documents. His lavish lifestyle was funded by the ill-gotten gains from these clandestine accounts, held at banks like UBS and Credit Suisse.

The scheme unraveled when Rotta attempted to shift funds after UBS faced scrutiny for aiding American tax dodgers. He then switched his money to Credit Suisse and Bank Bonhôte, but the IRS was soon on his trail. During an audit, Rotta tried to pass off his withdrawals as non-taxable loans from foreign nationals, providing fake documents in support of his claim.

Despite his lies, the IRS struck back with additional taxes, penalties, and interest totaling millions. Rotta fought back by filing a fraudulent petition in U.S. Tax Court, but the IRS saw through his ruse. Unbeknownst to them, the ‘loan repayments’ he claimed were merely funds cycling back into his control.

As the truth emerged, Rotta’s assets were seized, and the IRS caught wind of the sham trust structures he’d set up with American attorneys. In 2019, as more Swiss account records poured in, Rotta’s deception was exposed, leading to his conviction and sentence yesterday.

The sentence for Dan Rotta sends a stark message: even the most cunning criminals can be brought to justice, no matter how well they believe they’ve hidden their secrets.
