Michael Castelluccio, Unlawful Gun Sales, New York 2020

A Montgomery County man has been sentenced to 30 months in prison for unlawfully selling ‘ghost guns’.

On November 5, 2020, Michael Castelluccio, 43, of Fultonville, New York, pled guilty to one count of unlawful transfer of unregistered firearms. As part of his guilty plea, Castelluccio admitted to building, selling and transferring 19 firearms from component parts ordered online over the course of four transactions between August and September 2019.

The firearms, commonly known as ‘ghost guns,’ do not have serial numbers, making them difficult for law enforcement to trace. Castelluccio also admitted to modifying one of the firearms to allow it to automatically shoot more than one shot by a single function of its trigger.

This case was investigated by the ATF and Homeland Security Investigations, as well as the Schenectady County and Montgomery County Sheriff’s Offices. The case was prosecuted by Assistant United States Attorney Alexander Wentworth-Ping.

As part of the sentence, Castelluccio is to serve 30 months in prison, followed by 2 years of supervised release. He has also forfeited a pickup truck that he used to transport the firearms.

This case is part of Project Safe Neighborhoods (PSN), an evidence-based program proven to be effective at reducing violent crime. PSN focuses enforcement efforts on the most violent offenders and partners with locally based prevention and reentry programs for lasting reductions in crime.

Castelluccio is to begin serving his sentence immediately. He was previously released on bond pending sentencing.
