Felon in Possession of a Firearm Lands Boynton Man 188 Months Behind Bars
MUSKOGEE, OKLAHOMA – In a shocking turn of events, Michael Wayne Cherry, a 48-year-old resident of Boynton, Oklahoma, has been sentenced to 188 months imprisonment for Felon in Possession of a Firearm, in violation of Title 18 United States Code, Section 922(g)(1).
The charge arose from an investigation by the Muskogee County Sheriff’s Department, which led to Cherry’s indictment in December, 2013. Following a jury trial in September, 2014, he was found guilty of the crime.
According to the evidence presented at trial, on or about September 4, 2013, Cherry knowingly possessed a Mossberg model 500A, 12 gauge pump action shotgun that had been shipped and transported in interstate commerce, despite having been convicted of a crime punishable by imprisonment for a term exceeding one year.
The Honorable Ronald A. White, District Judge in the United States District Court for the Eastern District of Oklahoma, presided over the trial. Assistant United States Attorney Edward Snow represented the United States in the case.
Cherry will remain in the custody of the United States Marshal Service pending transportation to the designated federal facility, where he will serve his nonparolable sentence.
The case serves as a stark reminder of the consequences of violating federal firearm laws. It remains to be seen whether Cherry will appeal the sentence or begin serving his time.
In the meantime, the community is left to wonder how such a situation could have occurred under the radar. One thing is certain, however: Michael Wayne Cherry will be spending the next 15 years and 8 months behind bars for his crime.
