Minnesota Man Pleads Guilty To Failure To Pay Child Support

Failure to Pay Child Support Lands Minnesota Man in Hot Water

Larry T. Davis, a 38-year-old Marshall, Minnesota resident, has pleaded guilty to failure to pay legal child support, a federal offense that carries a maximum penalty of six months’ imprisonment and a $5,000 fine.

According to court documents, a past due child support obligation was imposed on Davis by the Third Judicial Circuit Court, Brookings County, South Dakota on January 1, 2010, for the benefit of his minor child. The obligation went unpaid for more than one year and was in an amount greater than $5,000.

At the time of the obligation, Davis was residing in Minnesota, while his minor child resided in South Dakota. Despite being aware of the unpaid support, Davis willfully and unlawfully failed to pay the obligation, which continued to accrue until the present day.

The investigation into Davis’ failure to pay child support was conducted by the Department of Health and Human Services, Office of Inspector General. The case is being prosecuted by Assistant U.S. Attorney Thomas J. Wright.

A presentence investigation has been ordered, and a sentencing date has been set for May 3, 2013. Davis was remanded to the custody of the U.S. Marshal pending sentencing, where he will face the consequences of his actions.

As a result of his guilty plea, Davis will be required to pay child support restitution in an amount owing at the time of sentencing, in addition to the fines and penalties associated with his conviction.
