Aberdeen, SD – U.S. District Judge Charles B. Kornmann handed down a harsh verdict to 42-year-old Brandon James Noisy Hawk, a Mobridge man convicted of Failure to Register as a Sex Offender.
Noisy Hawk was sentenced to 20 months in federal prison, followed by five years of supervised release, and ordered to pay a special assessment to the Federal Crime Victims Fund in the amount of $100.
Noisy Hawk was indicted by a federal grand jury in January of 2024 and pleaded guilty on March 18, 2024. This is his fourth conviction for failure to register as a sex offender.
The case against Noisy Hawk stems from his requirement to register as a sex offender under federal law for sexually abusing a 13-year-old-girl. After his last release from prison, Noisy Hawk registered a primary residence with the Mobridge Police Department, but failed to verify his address as required in October of 2023. He moved out of his home in November of 2023, only updating his address following his arrest on state charges on December 4, 2023.
This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse, launched in May 2006 by the Department of Justice. Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute individuals who exploit children, as well as identify and rescue victims.
Noisy Hawk’s case was investigated by the U.S. Marshals Service, with Assistant U.S. Attorney Carl Thunem prosecuting the case. Noisy Hawk was immediately remanded to the custody of the U.S. Marshals Service.
The Department of Justice’s Child Exploitation and Obscenity Section leads Project Safe Childhood, working alongside the U.S. Attorneys’ Offices to combat child exploitation and abuse. For more information about Project Safe Childhood, visit https://www.justice.gov/psc.
