Guatemalan Man Sentenced for Sex Assault and Illegal Reentry in Iowa
A 39-year-old Guatemalan man, Moses Suarez-Garcia, has been sentenced to 15 months in federal prison for illegally reentering the United States after being deported once. Suarez-Garcia, a citizen of Guatemala, has been residing in Dubuque, Iowa.
The prison term was handed down after Suarez-Garcia pleaded guilty on January 15, 2021, to one count of illegal reentry into the United States. This conviction stems from Suarez-Garcia’s November 2019 arrest for a sex assault charge. Dubuque police officers responded to a report of sexual abuse, and Suarez-Garcia was located at the scene along with another woman. Suarez-Garcia was charged with and ultimately convicted of assault with intent to commit sexual abuse.
Further investigation revealed that Suarez-Garcia had been removed from the United States in 2012 but had since illegally reentered the country. Suarez-Garcia’s illegal reentry into the United States was investigated by the Department of Homeland Security, Immigration and Customs Enforcement, Enforcement and Removal Operations.
United States District Court Judge C.J. Williams handed down the sentence in Cedar Rapids. Suarez-Garcia was sentenced to 15 months’ imprisonment and was ordered to make a payment of $100 to the special assessment fund. Additionally, he will serve a one-year term of supervised release after the prison term. There is no parole in the federal system.
