Nicholas Dee Birdtail, Domestic Assault, Montana 2025

GREAT FALLS, Montana – A Harlem man who brutally assaulted his domestic partner has been sentenced to 51 months in prison, followed by three years of supervised release, U.S. Attorney Kurt Alme said.

Nicholas Dee Birdtail, 53, pleaded guilty in January 2025 to one count of domestic assault by habitual offender. Chief U.S. District Judge Brian M. Morris presided over the case.

The government alleged that Birdtail, who was released on bond for previous domestic violence charges against his partner, Jane Doe, had slapped her across the face on September 2, 2023. Responding law enforcement officers observed a fresh handprint on the left side of Doe’s face, as well as bruises on her arms from the night before.

Birdtail’s violent history includes multiple misdemeanor domestic assaults in Billings municipal court, a felony partner family member assault conviction in Yellowstone County District Court, and a misdemeanor conviction for partner family member assault in Idaho.

Assistant U.S. Attorney Kalah Paisley prosecuted the case, with the investigation conducted by the FBI and Fort Belknap Law Enforcement Services.

This case is part of Project Safe Neighborhoods (PSN), a program aimed at reducing violent crime and gun violence by bringing together all levels of law enforcement and the communities they serve.

Birdtail’s sentence serves as a stark reminder of the consequences of domestic violence and the importance of holding perpetrators accountable for their actions.

The case highlights the ongoing efforts of law enforcement agencies to combat domestic violence and keep communities safe.
