A Fort Myers man has been sentenced to 5 years and 5 months in federal prison for distributing fentanyl, according to a recent sentencing.
Nicholas Smith, 45, was found guilty following a bench trial on August 21, 2024.
According to court documents, on September 5, 2023, officers with the Fort Myers Police stopped Smith for multiple traffic infractions near Winkler Avenue and Fowler Street in Fort Myers. During a subsequent search of Smith, officers retrieved a large plastic bag containing 11 smaller bags of a pink powdery substance that later tested positive for para-Fluorofentanyl and fentanyl, weighing 9.55 grams.
This case was investigated by Homeland Security Investigations and the Fort Myers Police.
It was prosecuted by Assistant United States Attorney Patrick L. Darcey.
