Excessive Force by Police Lands Former Officer in Hot Water
Nicole Murphy, a 31-year-old resident of Pittsburgh, Pennsylvania, has been sentenced to three years of probation for her role in the deprivation of rights under color of law. The first three months of her sentence will be served in home confinement, followed by nine months of in-home detention. In addition to her prison time, Murphy has been ordered to serve 100 hours of community service per year, with a focus on educating law enforcement about the dangers of excessive force.
The incident that led to Murphy’s conviction occurred on September 21, 2012, when she was still a police officer with the Millvale Police Department. On that day, Murphy deployed a taser on Thomas Smith, a handcuffed individual, while he was seated on the floor of the police department’s squad room. According to authorities, the taser was used in both drive and probe-stun modes, a clear violation of Smith’s constitutional right to be free from unreasonable force.
Murphy’s actions were thoroughly investigated by the Federal Bureau of Investigation, and she was subsequently charged with deprivation of rights under color of law. The case was prosecuted by Assistant United States Attorneys Carolyn J. Bloch and Cindy K. Chung.
U.S. Attorney David J. Hickton commended the FBI for their work in bringing Murphy to justice. ‘This sentence sends a clear message that excessive force by law enforcement will not be tolerated,’ Hickton said in a statement.
Nicole Murphy’s case serves as a stark reminder of the importance of police accountability and the need for law enforcement to respect the rights of all individuals, even those in custody. As the community continues to grapple with issues of police brutality and misconduct, cases like Murphy’s will play a crucial role in shaping the national conversation.
In the end, Nicole Murphy’s actions have consequences, and she will now have to live with the knowledge that her behavior was unacceptable. As she serves out her sentence and completes her community service, she will have the opportunity to reflect on the impact of her actions and work towards making amends.
