On January 9, 2026, around 3:17 p.m., an ECSO deputy, while off-duty, was exiting a parking lot on Elmwood Avenue in Buffalo when he collided with a pedestrian. The victim was rushed to the hospital but pronounced dead by early morning on January 10.

Pursuant to New York State Executive Law Section 70-b, OSI is mandated to assess and investigate any incident where a police or peace officer may have caused a death by an act or omission, irrespective of their duty status. The law applies to both armed and unarmed individuals, and those in custody or incarcerated.
