TUCSON, Ariz. – A harrowing encounter near the U.S.-Mexico border ended in charges for Erik Alberto Beal, 26, of Oro Valley. The defendant was indicted by a federal grand jury on May 1, 2024, on two counts of Assault of a Federal Officer with a Dangerous Weapon and Brandishing a Firearm During a Crime of Violence.
According to the prosecution, Beal confronted a U.S. Border Patrol Agent near Nogales on April 11, 2024, brandishing his Sig Sauer, Model P250, .45 caliber pistol. The incident unfolded as agents pursued a suspect who had jumped the International Boundary Fence. After a search, Beal emerged from a residence and pointed his firearm at the agent before being subdued.
For Assault of a Federal Officer with a Dangerous Weapon, Beal faces up to 20 years in prison, a $250,000 fine, or both. The Brandishing charge carries a mandatory minimum sentence of seven years to life imprisonment, along with a $250,000 fine or both penalties.
Assistant U.S. Attorney Serra M. Tsethlikai is leading the prosecution for the District of Arizona in Tucson. While an indictment is not proof of guilt, it does indicate that evidence was sufficient to charge Beal with the crimes. The Federal Bureau of Investigation and United States Customs and Border Protection’s Office of Professional Responsibility are assisting in the investigation.
