OU Health Pays $140,000 for Recordkeeping Violations
Oklahoma City, Oklahoma – OU Medicine Inc. d/b/a OU Health, a healthcare provider in Oklahoma, has agreed to pay $140,000 to settle allegations that its pharmacy, OU Health Physicians Building, violated federal regulations by accepting incomplete DEA Forms.
OU Health has owned and operated the OU Health Pharmacy in Oklahoma City since July 16, 2022. The pharmacy provides controlled substances to patients and physician clinics within the OU Health system.
According to the U.S. Attorney’s Office, OU Health accepted blank-signed DEA Form-222s from purchasers between November 16, 2020, and August 1, 2022. The pharmacy, not the purchaser, entered the descriptions and amounts of Schedule II substances on the forms.
The Comprehensive Drug Abuse Prevention and Control Act of 1970 requires healthcare providers to maintain accurate records of controlled substances. This includes filling out the purchaser portion of a DEA Form-222, specifying the descriptions and amounts of Schedule II substances being ordered, and providing the annotated form to the seller.
The failure to comply with these regulations can result in civil monetary penalties. In this case, OU Health agreed to pay $140,000 to the United States to settle the allegations.
OU Health did not admit liability in the settlement, and the government did not make any concessions about the legitimacy of the claims. The agreement allows the parties to avoid the delay, expense, inconvenience, and uncertainty involved in litigating the case.
This case was investigated by the Drug Enforcement Administration, Office of Diversion Control. U.S. Attorneys Ronald R. Gallegos and Amanda R. Johnson prosecuted the case.
