Parmelee Man Indicted for Firearm Offenses

Keena Two Eagle, 32, of Parmelee, South Dakota, has been indicted by a federal grand jury for Felon in Possession of a Firearm and Possession of a Firearm With an Obliterated Serial Number, according to a recent indictment.

Two Eagle was indicted on March 15, 2017, and appeared before U.S. Magistrate Judge Mark A. Moreno on April 12, 2017, pleading not guilty to the Indictment.

The charges allege that on December 24, 2016, Two Eagle knowingly possessed a 9mm caliber pistol and ammunition, with the manufacturer’s serial number removed, obliterated, and altered.

The maximum penalty upon conviction for Felon in Possession of a Firearm is up to 10 years in custody and/or a $250,000 fine, and 3 years of supervised release. The maximum penalty upon conviction for Possession of a Firearm With an Obliterated Serial Number is up to 5 years in custody and/or a $250,000 fine, and 2 years of supervised release.

Both charges could result in a $100 fine to the Federal Crime Victims Fund, and restitution. The investigation is being conducted by the Rosebud Sioux Tribe Law Enforcement Services, with Assistant U.S. Attorney Kirk W. Albertson prosecuting the case.

Two Eagle was remanded to the custody of the U.S. Marshals Service pending trial. A trial date has not been set. The charges are merely accusations, and Two Eagle is presumed innocent until and unless proven guilty.
