Local Woman Fails to Show in Court
Kamelia No Moccasin, a 29-year-old resident of Parmelee, South Dakota, has been charged with Failure to Appear in court. The maximum penalty upon conviction is 5 years in custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund, according to U.S. Attorney Brendan V. Johnson.
No Moccasin, also known as Kamelia Shoulders, was previously placed on personal recognizance after an initial appearance and arraignment on an Involuntary Manslaughter charge in U.S. District Court. As a condition of her release, she was required to attend all court proceedings.
However, on June 11, 2013, No Moccasin failed to appear for her trial at 9:00 am, as ordered. She was apprehended and arrested on June 20, 2013, after failing to show up for her scheduled court appearance.
The investigation into the case was conducted by the U.S. Marshals Service, with Assistant U.S. Attorney Marie H. Ruettgers handling the prosecution.
No Moccasin appeared before U.S. District Judge Roberto A. Lange on October 24, 2013, and pled guilty to Failure to Appear. A presentence investigation has been ordered, and a sentencing date has been set for December 3, 2013. The defendant has been remanded to the custody of the U.S. Marshals Service pending sentencing.
No Moccasin’s failure to appear in court has sparked concerns about the reliability of the justice system. ‘This case highlights the importance of attending court proceedings and the consequences of failing to do so,’ said U.S. Attorney Johnson. ‘We take these matters seriously and will continue to pursue justice in all cases.’
The case is a sobering reminder of the serious consequences of failing to comply with court orders. As the investigation and prosecution continue, it remains to be seen what the ultimate outcome will be for Kamelia No Moccasin.
