Paul John Herbert, False Statement, Massachusetts 2023

Former U.S. Marine Paul John Herbert has pleaded guilty to making false statements about his military service.

In a federal court in Springfield, Massachusetts, Herbert admitted to submitting a false Purple Heart application to the United States Marine Corps through his local Congressman.

The 54-year-old from Shelburne Falls, Massachusetts, faces up to five years in prison, three years of supervised release, and a fine of $250,000 or twice the gross gain or loss, whichever is greater.

Herbert pleaded guilty to one count of making false statements, a charge that was brought against him after a federal grand jury indicted him in September 2023.

Herbert submitted numerous false statements to the VA concerning IED-related injuries in support of a claim for disability compensation. As a result, the VA overpaid him $344,040 between January 1, 2010 and March 1, 2023.

U.S. Attorney Leah B. Foley called Herbert’s actions an ‘affront to all the members of the military who serve our country with courage and honor.’

The investigation into Herbert’s actions was led by the Department of Veterans Affairs Office of Inspector General’s Northeast Field Office and the Defense Criminal Investigative Service.
