Porcupine Man Indicted for Child Pornography
A Porcupine, South Dakota, man has been indicted by a federal grand jury for his alleged involvement in child pornography.
Jefferson Swallow, 23 years old, was indicted on September 22, 2014, and appeared before U.S. Magistrate Judge Veronica Duffy on September 25, 2014, where he pled not guilty to the charges.
According to the indictment, Swallow knowingly received and possessed computer files containing images of child pornography between March 2014 and August 2014, at Porcupine, South Dakota.
The penalty upon conviction is a mandatory minimum of 5 years’ imprisonment up to 20 years’ imprisonment and/or a $250,000 fine, lifetime of supervised release, and a $100 assessment to the Federal Crime Victims Fund. Restitution may also be ordered.
The investigation was conducted by the Federal Bureau of Investigation and the Bureau of Indian Affairs Office of Justice Services. Assistant U.S. Attorney Sarah B. Collins is prosecuting the case.
Swallow was detained pending trial. A trial date has not been set. The charges are merely accusations, and Swallow is presumed innocent until and unless proven guilty.
