Child Pornography Epidemic Continues: Local Man Caught Trading Explicit Content.

Rochester, NY – In a shocking turn of events, convicted felon Preston Herbst, 27, of Canandaigua, New York, has pleaded guilty to transferring obscene matter. This latest offense comes just months after Herbst was sentenced to serve 36 months in prison for possession of child pornography.

According to sources close to the investigation, Herbst was allowed to self-surrender to the Bureau of Prisons and was scheduled to begin his sentence on October 12, 2023. However, on September 3, 2023, the National Center for Missing and Exploited Children received information from Snap Inc., that a user had uploaded child pornography to the Snapchat platform.

Further investigation revealed that the user was none other than Herbst, who had used a prohibited device in violation of his release conditions while under the supervision of United States Probation. The search of Herbst’s Snapchat account determined that he used the account to trade child pornography in September 2023, after he had been sentenced, but before self-surrendering to the Bureau of Prisons.

The Federal Bureau of Investigation (FBI), under the direction of Special Agent-in-Charge Matthew Miraglia, conducted the investigation that led to Herbst’s plea. Assistant U.S. Attorney Kyle P. Rossi is handling the case.

The charge of transferring obscene matter carries a maximum penalty of five years in prison and a $250,000 fine. Sentencing is scheduled for September 3, 2024, at 3:00 p.m. before Judge Frank P. Geraci.
