Rochester, N.Y. – In a shocking twist, Preston Herbst, a 28-year-old Canandaigua resident, has been sentenced to 60 months in prison for a new child pornography charge. This conviction comes on the heels of his previous conviction for transferring obscene matter.
According to U.S. Attorney Trini E. Ross, Herbst’s sentence will be served following the completion of a 36-month sentence previously imposed by U.S. District Judge Frank P. Geraci. This new sentence adds an additional 24 months to Herbst’s already lengthy prison term.
Herbst’s troubles with the law began in July 2023, when he was sentenced to 36 months in prison for possession of child pornography. However, before he was set to begin his sentence, authorities caught wind of a new crime.
On September 3, 2023, the National Center for Missing and Exploited Children received a tip from Snap Inc. that a user had uploaded child pornography to the Snapchat platform. Further investigation revealed that the user was none other than Preston Herbst.
Despite being under supervision by the United States Probation office, Herbst was found to have used a prohibited device to upload the child pornography in September 2023. This egregious violation of his release conditions led to the new charges against him.
The investigation into Herbst’s activities was led by the Federal Bureau of Investigation, under the direction of Special Agent-in-Charge Matthew Miraglia. Assistant U.S. Attorney Kyle P. Rossi handled the case.
Herbst’s shocking descent into a life of crime is a stark reminder of the devastating consequences of child pornography. As he begins his new sentence, the community can take comfort in knowing that justice has been served in this disturbing case.
