Prohibited Person Charged with Gun Possession
A 29-year-old St. Francis, South Dakota man has been indicted for allegedly possessing a firearm, a crime that carries a maximum penalty of 10 years in custody and/or a $250,000 fine.
Cody James Horse Looking, a resident of St. Francis, was indicted by a federal grand jury on August 19, 2014, for Possession of a Firearm by a Prohibited Person. He appeared before U.S. Magistrate Judge Mark A. Moreno two days later and pled not guilty to the Indictment.
The Indictment alleges that on or about February 15, 2014, Horse Looking knowingly possessed a firearm, which had been shipped and transported in interstate and foreign commerce. This charge is a serious offense, considering Horse Looking’s previous conviction for a misdemeanor crime of domestic violence.
The investigation into the case is being conducted by the Rosebud Sioux Tribe Law Enforcement Services and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant U.S. Attorney Timothy M. Maher is prosecuting the case.
Horse Looking was released on bond pending trial, and a trial date has not been set yet. The charge is merely an accusation, and Horse Looking is presumed innocent until and unless proven guilty.
According to the Indictment, the maximum penalty upon conviction is up to 10 years in custody, or a $250,000 fine, 3 years of supervised release, and $100 to the Federal Crime Victims Fund. Restitution may also be ordered.
This case highlights the importance of strict gun laws and the consequences of violating them. As this case moves forward, it will be interesting to see how it unfolds.
