Grimy Times Exposes Rafael Martinez’s PPP Loan Scam
In a shocking turn of events, Rafael Martinez, the CEO of MBE Capital Partners, LLC, has pleaded guilty to conspiring to commit wire fraud in connection with loan and lender applications submitted through the Paycheck Protection Program (PPP).
Martinez’s scheme involved false representations and documents to fraudulently obtain approval from the U.S. Small Business Administration (SBA) for his company to be a non-bank lender through the PPP. He engaged in this criminal conduct to secure hundreds of millions of dollars in capital for PPP loans and collect approximately $71 million in lender fees.
According to the allegations, Martinez used false statements and forged documents to obtain a PPP loan for MBE in the amount of approximately $283,764. He also misrepresented the number of employees at MBE and their wages to secure the loan. The loan proceeds were disbursed to a bank account controlled by Martinez, and a majority of the funds do not appear to have been used for payroll or business expenses.
On or about April 5, 2020, Martinez applied for a government-guaranteed loan for Republic Group, a company owned and controlled by Martinez, through the SBA’s PPP. He represented that MBE had as many as 15 employees and an average monthly payroll of approximately $119,390 in 2019. In reality, MBE had at most four employees with a total average monthly payroll of no more than $25,000.
The guilty plea marks a significant victory for the U.S. Attorney’s Office for the Southern District of New York, which has been actively investigating and prosecuting individuals and entities involved in PPP loan fraud. Martinez’s abuse of the system during a time of crisis has been brought to light, and he will now face the consequences of his actions.
