A Council Bluffs man has been sentenced to 46 months in federal prison for attempting to elude law enforcement while armed with a loaded pistol.
According to public court documents, Rafael Partida, 47, was attempting to evade law enforcement on May 19, 2024, while riding a motorcycle in Iowa. An Iowa State Patrol Trooper attempted to stop Partida, but he eventually crashed the motorcycle and fled on foot, discarding a backpack in the process.
Partida was apprehended after a brief pursuit. A search of the backpack revealed a loaded handgun and 23 additional rounds of ammunition. This discovery led to Partida’s arrest and subsequent charges.
On April 15, 2025, Partida was sentenced to 46 months in federal prison for possessing a firearm as a felon.
After completing his term of imprisonment, Partida will be required to serve a three-year term of supervised release. It is worth noting that there is no parole in the federal system.
This case was investigated by the Iowa Department of Public Safety—Division of Narcotics Enforcement and the Iowa State Patrol. United States Attorney Richard D. Westphal of the Southern District of Iowa made the announcement.
