Raphael Oswald, Identity Theft, Florida 2013

A Palm Beach resident has been sentenced to 74 months in prison for his involvement in a massive stolen identity tax fraud scheme.

Raphael Oswald, 37, of Riviera Beach, was handed the sentence for his role in filing over 100 fraudulent federal tax returns, which ultimately netted him $139,308 in refunds.

According to court documents, Oswald used stolen personal identifying information of numerous individuals to file the fake returns, which were then directed into bank accounts in his company’s name.

Once the refunds were deposited, Oswald made a series of cash withdrawals and purchased personal items from the accounts.

The scheme was uncovered by law enforcement in August 2013, when Oswald attempted to purchase and finance a 2006 Porsche and BMW X-5 in New York using a stolen identity.

During the investigation, authorities discovered that Oswald had presented a fraudulent passport and driver’s license to the car dealerships, both bearing his photo but in the name of the woman whose identity he had stolen.

U.S. Attorney Wifredo A. Ferrer commended the investigative efforts of the IRS-CI, which led to Oswald’s downfall.

Assistant U.S. Attorney Cynthia R. Wood prosecuted the case, which was announced by Ferrer and Kelly R. Jackson, Special Agent in Charge of the IRS-CI.
