Rapid City Man Pleads Guilty to Failure to Register

Wilbur Flute, a 39-year-old Rapid City man, admitted to violating the law by failing to update his sexual offender registration.

According to U.S. Attorney Brendan V. Johnson, Flute appeared before U.S. Magistrate Judge Veronica L. Duffy on April 12, 2013, and pled guilty to the charge of Failure to Register.

The investigation into Flute’s actions was conducted by the U.S. Marshals Service, with Assistant U.S. Attorney Eric Kelderman handling the prosecution.

Flute failed to update his registration as required from November 28, 2012, to February 27, 2013, risking a maximum penalty of 10 years’ imprisonment and/or a $250,000 fine upon conviction.

A presentence investigation has been ordered, and a sentencing date will be scheduled in the coming weeks. Flute is currently being held in the custody of the U.S. Marshal pending sentencing.

Johnson stressed the importance of the Sexual Offender Registration and Notification Act (SORNA), which aims to protect communities from sex offenders who fail to register their whereabouts.
