INDIANAPOLIS – Gilberto Hernandez-Sanchez, 29, a citizen of Mexico, has been found guilty by a federal jury of illegally re-entering the United States – for the fourth time. The verdict comes after a trial detailing a pattern of disregard for U.S. immigration law and a history of violent offenses, culminating in his arrest while serving time for domestic battery.
Court records reveal Hernandez-Sanchez was initially removed to Mexico in 2021. But that didn’t stop him. He resurfaced in 2024, not on the streets, but within the walls of the Plainfield, Indiana Correctional Facility, where he was already serving a sentence handed down by state authorities for a conviction on charges of domestic battery. This latest arrest triggered the federal reentry charge, showcasing a revolving door of immigration enforcement failures.
The prosecution laid out a damning timeline. Hernandez-Sanchez first illegally crossed the Mexican border on August 5, 2014, without any legal authorization. He was promptly removed. That same month, he attempted the crossing – and failed – twice more, each time being sent back to Mexico. He again managed to sneak into the country at an undetermined date, only to be removed once again in November 2021. Undeterred, he re-entered the U.S. in 2022, leading to the state charges that ultimately landed him in Plainfield – and then, a federal courtroom.
Hernandez-Sanchez isn’t just an immigration violator; he’s a repeat offender with a documented history of violence. His criminal record includes convictions for false informing, public intoxication endangering the life of another, battery resulting in bodily injury, and, critically, domestic battery resulting in serious bodily injury. The pattern paints a disturbing picture of escalating aggression and a blatant disregard for the law. This isn’t a simple case of seeking a better life; it’s a pattern of criminal behavior continuing across international borders.
The case was investigated by U.S. Immigration and Customs Enforcement (ICE), highlighting the agency’s ongoing efforts to track and prosecute individuals who repeatedly violate immigration laws. U.S. District Judge James P. Hanlon presided over the trial, and will determine Hernandez-Sanchez’s sentence at a future hearing. Assistant U.S. Attorneys Carolyn Haney and Adam Eakman are prosecuting the case.
This prosecution falls under the umbrella of “Operation Take Back America,” a nationwide initiative spearheaded by the Department of Justice. The operation aims to combat illegal immigration, dismantle transnational criminal organizations, and protect communities from violent crime by streamlining resources from the Organized Crime Drug Enforcement Task Forces (OCDETFs) and Project Safe Neighborhood (PSN). Whether this initiative will finally break the cycle with Hernandez-Sanchez remains to be seen, but the federal government is signaling a hard line on repeat immigration offenses tied to criminal activity.
