MARTINSBURG, WEST VIRGINIA – A local man has been accused of violating federal firearms laws. Richard Brent Collum, 36, of Harpers Ferry, West Virginia, was indicted today on a charge of Unlawful Possession of a Firearm.
According to court documents, Collum is a person prohibited from having a firearm because of a prior conviction. He is accused of having a .45 caliber handgun in August 2021 in Jefferson County.
Collum faces up to 10 years of incarceration and a fine of up to $250,000 for each count. Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offenses and the prior criminal history, if any, of the defendant.
The investigation was led by the Charles Town Police Department. Assistant U.S. Attorney Timothy D. Helman is prosecuting the case on behalf of the government.
It is worth noting that an indictment is merely an accusation. Collum is presumed innocent unless and until proven guilty.
An indictment is a formal accusation of a crime, and it does not necessarily mean that the defendant will be found guilty. The case will proceed to trial, where the prosecution will present evidence to support the charges.
