Rio Bravo Smuggler Pena Gets 63 Months

LAREDO, Texas – A decades-long criminal, Antonio Pena, 57, of Rio Bravo, Texas, is headed to federal prison after being caught cramming three Mexican nationals into his vehicle. Pena was sentenced to 63 months, followed by three years of supervised release, for his role in a human smuggling operation, U.S. Attorney Nicholas J. Ganjei announced. The case, delayed for publication due to the recent government shutdown, reveals a callous disregard for human life and a persistent pattern of criminal behavior.

The incident unfolded February 14th when law enforcement officers observed a black Chevrolet Cruz noticeably overloaded and sagging in the rear. Pena pulled into a gas station, claiming he was simply refueling. However, his demeanor—nervous stuttering and a tight grip on his phone—immediately raised suspicions. He insisted no one else was in the vehicle, while clutching only a single car key, a detail that didn’t pass muster with the responding officers.

A search quickly revealed the grim reality: one individual concealed on the floorboard and two more packed tightly into the trunk. All three were identified as citizens of Mexico unlawfully present in the United States. One of the smuggled individuals confessed to wading across the Rio Grande, expecting transport to Atlanta. He described finding two others already hidden in the trunk, and being instructed by Pena to lie on the floorboard.

During the sentencing hearing before U.S. District Judge Marina Garcia Marmolejo, the court highlighted the extensive criminal history of Antonio Pena, including a prior homicide conviction. Judge Marmolejo emphasized Pena’s long-standing danger to the community, as well as reports of attacks on fellow inmates while awaiting trial. The cramped and dangerous conditions Pena subjected the smuggled individuals to were also a key factor in the sentencing.

The investigation was spearheaded by the U.S. Border Patrol, with prosecution handled by Assistant U.S. Attorney Tae W. Chon. This case falls under Operation Take Back America, a nationwide initiative designed to combat illegal immigration, dismantle cartels, and protect communities from violent crime. The operation leverages resources from the Department’s Organized Crime Drug Enforcement Task Forces and Project Safe Neighborhood.

Pena’s sentence sends a clear message: profiting from the desperation of others and endangering lives will not be tolerated. While the government shutdown briefly stalled the public release of this information, the wheels of justice have turned, and Antonio Pena will now face the consequences of his actions behind bars.
