Robert Hybertson, 59, of Brighton, Colorado, appeared before U.S. Magistrate Judge Scott T. Varholak today for arraignment and a detention hearing. Despite being charged with multiple crimes, Hybertson was ordered released on bond.

Hybertson, the owner and operator of Black Hills Rig Heaters, a South Dakota Business trust, is accused of failing to file federal income tax returns for himself and his business from early 2006 through 2014. However, he continued to receive benefits through February 2017 despite being self-employed and working for someone else.

Hybertson is charged with one count of corrupt endeavor to obstruct or impede the due administration of the Internal Revenue Laws, four counts of failure to file a return, one count of concealment related to his receipt of Social Security benefits, and one count of false statements in determining benefits. If convicted, he faces penalties ranging from one year to five years in prison and fines up to $250,000.
