ELKINS, WEST VIRGINIA – In a gritty admission of guilt, Floyd Edward Roby, 41, from Buckhannon, West Virginia, has confessed to a firearms charge. United States Attorney Bill Powell broke the news that Roby has pled guilty to one count of ‘Unlawful Possession of a Firearm.’
The admitted offense took place in January 2019 when Roby was found with a 9mm pistol in Upshur County, despite having a prior felony conviction. This latest charge could see Roby incarcerated for up to ten years and fined as much as $250,000.
Under the Federal Sentencing Guidelines, the severity of Roby’s offense and his prior criminal history will determine the actual sentence imposed.
This case is part of Project Safe Neighborhoods (PSN), a Department of Justice initiative aimed at reducing violent crime. PSN identifies and tackles the most pressing violent crime issues in communities, focusing on the enforcement against the most dangerous offenders while also partnering with local programs for long-term crime reduction.
Assistant U.S. Attorney Brandon S. Flower is prosecuting the case, with support from the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Upshur County Sheriff’s Office. The presiding judge was U.S. Magistrate Michael John Aloi.
