Robert Colon, Fentanyl Possession with Intent to Distribute, New York 2022

ROCHESTER, NY – Robert Colon, 32, of Rochester, admitted today to peddling poison on the streets, pleading guilty to possession with intent to distribute fentanyl. The case, a grim reminder of the opioid crisis choking this city, was heard before U.S. District Judge Frank P. Geraci, Jr.

According to Assistant U.S. Attorney Cassie M. Kocher, Colon wasn’t dealing in small amounts. Between January 2022 and March 9, 2022, he repeatedly sold fentanyl, cocaine, and the even more potent para-fluorofentanyl to an undercover officer. That reckless behavior earned him a warrant, and on May 30, 2022, Colon was finally taken into custody.

The bust wasn’t just about the warrant. A search revealed Colon was carrying a significant supply: approximately 189 baggies of fentanyl, 16 baggies of cocaine, and a cool $1,748 in cash – dirty money earned from pushing deadly drugs. This wasn’t a first offense, it was a calculated effort to profit from addiction and despair.

The investigation, a collaborative effort, involved the Rochester Police Department, led by Chief David Smith, the Greater Rochester Area Narcotics Enforcement Team, and Homeland Security Investigations, under the direction of Special Agent-in-Charge Matthew Scarpino. These agencies worked tirelessly to get this dealer off the streets, and today’s plea is a victory, albeit a small one, in the ongoing war on drugs.

Colon now faces a maximum sentence of 20 years behind bars and a staggering $1,000,000 fine. While prison won’t undo the harm he’s caused, it will hopefully prevent him from inflicting further misery on the community. Sentencing is scheduled for June 15, 2023, at 2:00 p.m. before Judge Geraci.
