ALBANY, NEW YORK – In a high-profile immigration enforcement case, 32-year-old Boston native Willy Rodriguez has been sentenced to time served following his illegal re-entry into the United States after being deported. Rodriguez faced a term of 7½ months in prison, but was granted leniency by Senior U.S. District Court Judge Frederick J. Scullin.
United States Attorney Richard S. Hartunian and Thomas P. Brophy, Acting Field Office Director for ICE Enforcement Removal Operations (ICE/ERO), Buffalo Field Office, announced the sentence. Rodriguez, who had been deported to the Dominican Republic in 2011 following a drug trafficking conviction in Providence, Rhode Island, was arrested by City of Amsterdam Police and ICE officers on August 23, 2016.
During his initial encounter with law enforcement, Rodriguez was deemed an alien unlawfully present in the U.S. A subsequent fingerprint check confirmed his prior removal status. Following his arrest, Rodriguez pled guilty to a violation of the Immigration and Nationality Act, which specifically prohibits aliens who have been previously removed from returning to the United States without permission.
The investigation into Rodriguez’s case was conducted by the Department of Homeland Security in conjunction with ICE Enforcement & Removal Operations (ERO), supported by the Amsterdam NY Police Department. Assistant U.S. Attorney Edward P. Grogan prosecuted the matter.
With this sentence, Rodriguez will be eligible for removal proceedings from the United States, marking a stark reminder of the consequences faced by those who defy immigration laws and the efforts of federal agencies to enforce them.
